PURPOSE

This document establishes the general contracting terms and conditions (hereinafter, the "Terms and Conditions") that govern the terms on which the leaploot.com´s website (hereinafter, the "Website"), that provides a list of downloadable apps from third parties through which advertisers or app owners, may provide Rewards to an User (hereinafter, where applicable, the "User" or "Users") on the basis of their engagement with the objectives set forth in the Website (the “Objectives”) regarding the apps that can be downloaded therein and the visualization of advertisements (the “Ads”)(hereinafter, jointly referred to as "Services" or “Activities”). 

Alongside these Terms and Conditions, the specific conditions relating to certain additional aspects with respect to the applicable regulations of each territory where leaploot.com provides its Services (hereinafter the "Special Conditions") shall also apply. These Special Conditions will be an indivisible part of this document and will complement and, where appropriate, prevail over the provisions of these Terms and Conditions.

Any matter not expressly set forth in these Terms and Conditions shall be deemed to be reserved to leaploot.com, without prejudice to the application of the provisions of the applicable regulations. Also, leaploot.com reserves the right to carry out modifications and/or updates in the present Terms and Conditions, which will be previously informed to the User for acceptance or rejection in case of being substantial. Minor modifications and/or updates that only insignificantly change the balance of performance and counter-performance of the contracting parties can be carried out with prior notice. 

When signing up for, or otherwise using, the Website, you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, then you must not sign up and stop using the Website. In this sense, the User acknowledges that they are a person with sufficient capacity to acquire the obligations derived from their actions through the Website, which they have previously read and understood its content.

In any case, in order to contract with leaploot.com, the User must be of legal age (≥ eighteen (18) years). This includes a liveliness check to ensure the User is human, and measures to prevent a User from having more than one (1) accountin accordance with the terms and conditions. This may be done through one of the following options: biometric identification (where permitted by applicable law), which entails the use of the User’s biometric template to identify matches in the user’s database, or the User printing out a form with a unique code and mailing it to leaploot.com along with a proof of address. leaploot.com reserves the right to check any account created and request reasonable and justifiable information to verify the identity of the User and his/her age. 

CONDITIONS OF USE

The User shall be exclusively responsible for accessing and browsing or using the Website and participating in the Services for illegitimate and/or illicit purposes. By way of illustration but not limited to, it is forbidden:

1. to use the Website for the purpose of causing damages, inefficiencies, interruptions or similar defects in the functionality of the Website or electronic structures of leaploot.com or any third party;
2. to use the Website for the transmission of malware, viruses or similar programs or to publish or disseminate content of an offensive, racist, denigrating or pornographic nature that could cause annoyance to people;
3. to use the Website to the detriment of leaploot.com's interests;
4. to utilize bots or any type of software or hardware to engage the Services and gain Rewards, including any software that allows the User to falsify data relating to their input, or that allows the User to appear to be watching the Ads when in reality they are not, or otherwise rely on unfair tactics to gain Rewards;
5. to register on the Website with a false identity, or a mobile phone number which does not belong to the User;
6. to violate the security measures established by leaploot.com;
7. to carry out actions tending to collapse the Website, damaging the good functioning of the Website; and in any case
8. to use the Website illegally.

Furthermore, leaploot.com reserves the right to temporarily/permanently ban/block access for Users who:

1. Access (or attempt to access) any of our Services by any means other than through the interface that we provide.
2. Attempt to impersonate another user or person or use the username of another user.
3. Attempt to obtain account information, passwords, or other private information from other Users.
4. Using multiple accounts or more than one account per household.
5. Maintain or use any false identity or multiple identities, or otherwise fail to participate in our Services using your real identity and accurate contact, demographic and other information.
6. Submit any personal information (name, email, zip code, etc.), payment information (credit card number and expiration date, etc.), or other information which we determine in our sole discretion to have been false, inaccurate or otherwise invalid in connection with any Activities or any other use of the Website and/or the Services.
7. Develop, distribute, make use of, or publicly inform other members of: “auto” software programs, “macro” software programs, web crawlers or other script or “cheat utility” software programs or applications.
8. Share or distribute survey IDs, answers or other survey information, or otherwise coach or assist other members with regard to qualifying for or answering surveys.
9. Receiving offer chargebacks.
10. Share a single Account with any person other than the registered Account holder.
11. Using any type of VPN, VPS
12. Using any kind of Emulator software, this includes the use of any automation tool even if it is executed on real devices.
13. Using fake SMS numbers, Google Voice or VOIP when verifying User’s phone number.
14. Completing many offers in a short space of time.
15. Completing suspicious offers which have a high rate of chargeback.
16. Exploit, distribute or publicly inform other members of any error, miscue or bug (“Error“) that gives an unintended advantage, violate any applicable laws or regulations, or promote or encourage any illegal or unauthorized activity including, but not limited to, hacking, cracking or distribution of counterfeit software, or cheats or hacks for our Services. If you find an Error, we kindly request that you report it to our appropriate support team ([email protected]).
17. Make improper use of our support services, or submit false reports of abuse or misconduct.
18. Use the Website or our content as part of any effort to compete with us or to create a revenue-generating endeavor or commercial enterprise.
19. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Website.
20. Attempt to access any portions of the Website that you are restricted from accessing.
21. Harass, annoy, intimidate, or threaten any of our employees, agents, or other users.
22. Delete the copyright or other proprietary rights notice from any of the content.
23. Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
24. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Site, or any material that acts as a passive or active information collection or transmission mechanism.
25. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Website.
26. Use the Website in a manner inconsistent with any applicable laws or regulations.

If leaploot.com encounters any of the cases mentioned in the previous paragraph, leaploot.com reserves the right to adopt the measures it deems appropriate, including the right to nullify all Rewards earned by the Users that have infringed the preceding limitations, to disable the redemption of Rewards by said Users, regardless of any justification provided, and to ban any User for using the Website with a prior notification.

WARRANTIES AND REPRESENTATIONS

leaploot.com will make its best efforts to warrant the accuracy, usefulness, or veracity of absolutely all the information on the Website, or the usefulness or veracity of the contents made available to users through it. However, Users are informed that leaploot.com cannot guarantee that the Website will work correctly all the time or that it will be completely free of errors or bugs.

Therefore, leaploot.com does not warrant or guarantee nor is responsible, to the extent permitted by applicable law, for:

1. the continuity of the contents of the Website;
2. the absence of mistakes in said contents;
3. the availability of the apps offered through the Website;
4. the absence of viruses, Trojans, worms, logic bombs and/or other malicious or technologically harmful components on the Website or on the server that supplies it;
5. the invulnerability of the Website and/or the impossibility of violating the security measures adopted therein;
6. the lack of usefulness or performance of the contents of the Website;
7. failures of the Website caused by any type of attack on its servers or those of third party service providers of the Website, as well as technical or system security failures of any of these providers hindering the functioning of the Website;
8. any technical failure of any kind that hinders, delays or prevents the proper functioning of the Website;
9. the damages inflicted, to itself or to a third party, any person who infringes the conditions, rules and instructions that leaploot.com establishes in the Website or through the violation of the security systems;
10. the continuity of any software provided by a third-party;
11. the availability of a redemption method which requires a third-party to provide a good or service;
12. the content downloaded through the Website;
13. the Redemptions redeemed through the exchange of Rewards in the Website.

Some jurisdictions do not permit the waiver of some of these warranties and so such waivers may not apply to the User. If the User is dissatisfied with the Website his sole remedy is to discontinue use of the Website.

leaploot.com declares that it has taken all necessary measures, within its capabilities and the state of the art, to ensure the functioning of the Website and minimize system errors, both from the technical point of view and the content published on the Website.

SERVICE PROCESS

Once the registration process detailed in the section above has been completed, the User may access the app catalog provided in the Website, in their country of residence, and download the apps to their Hardware devices in order to begin the completion of Objectives and earn Rewards.

6.1.- Rewards

leaploot.com offers Rewards (the “Rewards”), used as virtual redemption credit in the leaploot.com App, and referred to as “COINS” inside the Website, to Users in exchange for completing Objectives involving downloading apps found in the Website and from the visualization of Ads. Users can redeem Rewards through different methods, to exchange said Rewards for the currencies offered by leaploot.com, such as gift cards, amongst others (the “Redemption” or the “Redemptions”). The Rewards cannot be redeemed for cash or in any way resold, exchanged, or returned for a cash refund, unless required by law. Rewards may be redeemed in countries where applicable merchants and services are available. leaploot.com is not responsible for any valid Redemptions which the User is unable to redeem due to their age, situation, or country of residence. leaploot.com is not responsible for any lost, stolen, or malfunctioning Redemptions except when caused by gross negligence or wilful misconduct of leaploot.com, to the extent permitted by applicable law. 

6.2.- Reward Obtention

To gain Rewards, the User must carry out the Activities of downloading apps or seeing Ads. 

The obtention of Rewards and the Activities does not involve any element of chance. 

Users will be required to achieve different Activities per offer in order to obtain the rewards. Both the reward amount per Activity and the specific Activities will be detailed in the offer itself, leaploot.com can in any case modify or adapt reward values and Activities required from third party advertisers, but leaploot.com will not be responsible for any third-party acceptance of the Rewards or chargebacks of the Activities achieved. In any case reward values will be valid by the time they are completed and any modification on offer/tasks requirements nor rewards won’t be applied retroactively. 

Users will have a specific time to achieve all Activities included in any offer of thirty (30) days by default unless Offer’s description says otherwise. As well any Offer may have any extra requirements that are completely out of leaploot.com’s control and rely on Offer’s publisher.

Rewards may take up to 15-Days to be available at User’s balance after completion, also leaploot.com can modify reward values added/subtracted to Balance at any time. 

Rewards and/or Balance modifications will be notified to Users through the notification system included in the website, leaploot.com can also notify the users in addition by any other methods like email/SMS notification.

All the Rewards for the Services are cited with the description of the different Objectives found through the Website.

Additionally, leaploot.com may provide Rewards on their sole discretion, through the implementation of different promotions such as “Welcome Bonus”, “Sign-Up Bonus' or “Returning Player-Bonus”, amongst others. Users can be but don’t have to be entitled to a bonus of a varying amount of Rewards. The amount can vary based on a range of factors including but not limited to the geographic location of the User. In all cases, the provision of Rewards by these methods shall exclusively be decided at the discretion of leaploot.com, who shall also be able to detract such Rewards from the User due to valid Reasons.

6.3.- Rewards Redemption

For Users 18 years or older, when redeeming a Rewards through the Website, verification of the User may be required, using verification technology for this purpose. The use of this information shall exclusively be undertaken for the purpose of fraud prevention and to ensure that prizes are not earned through bots or other computed programs, automated processes or fraudulent use of software. The verification shall exclusively attend to fraud prevention measures. If the User does not wish to redeem Rewards through the Website, they shall be able to continue to use all other features of the Website without providing the aforementioned content.

Rewards expire automatically one year after they have been earned by the User, unless they have been previously redeemed, in which case they shall be subtracted from the User account.

ENHANCED-GAMING FEATURES

The User should note that some of the features mentioned below may not be available at the time these Terms and Conditions are posted. Notwithstanding this, the functionalities and conditions associated with them will be applicable as soon as they are implemented on leaploot.com.

7.2 Referral Program

Users may share their referral codes with non-users and become referrers, thus being able to obtain unique bonuses. There is no maximum number of referees per referrer. Referrers can earn bonuses based on the earnings of their referees, which will be calculated using a tiered system.

Temporarily banned Users by leaploot.com will continue to receive Rewards from their referees, while Users who have had their accounts terminated or permanently deleted will not be subject to receiving Rewards from their referees.

leaploot.com reserves the right, at its sole discretion, to modify any of the tier requirements and commission percentages that apply to referrers and referees.

The referrers acknowledge and accept that they have read the Privacy Policy and commit to adhering to its stipulations regarding the processing of the referees' data.

7.3 Leveling Feature

Users will earn experience points (XP) based on their activities and earnings from the use of the Services. The aforementioned XP will grant levels to Users, which will result in unlocking and access to certain parts of leaploot.com or special and exclusive perks.

leaploot.com reserves, in its sole discretion, the right to modify any of the XP requirements, as well as any of the benefits associated with XP.

7.4 Daily Task Missions

Users, through the use of the Services, may complete daily missions or tasks to earn platform COINS. Completing these daily missions or tasks consecutively will result in the User entering a "streak", which will grant additional Rewards to those contemplated in the immediately preceding paragraph.

leaploot.com reserves, at its sole discretion, the right to modify any of the tasks, missions, Rewardsand requirements thereof.

7.5 Public Profile

Users, through their use of the Services, will have a public profile, which will display various information to other Users, such as nickname, avatar, achievements and/or activity statistics.Users will have control over the visibility of their public profile through their privacy settings.

leaploot.com reserves, at its sole discretion, the right to modify the characteristics of Users' public profiles.

7.6 Rankings

Users are automatically enrolled into seasonal country rankings, measuring earnings during the ranking period. Based on the total earnings of each User, they will be assigned a position in these rankings, which will result in Rewards, directly related to their position. Ranking positions and Rewards are regularly published on the Website.

leaploot.com reserves, at its sole discretion, the right to modify the rankings operation and Rewards distribution.

7.7 Achievements

Users can earn achievements as they complete specific activities on leaploot.com. These achievements may unlock special Rewards, such as visual effects or assets, as well as perks.

leaploot.com reserves, at its sole discretion, the right to modify the requirements and rewards associated with achievements.

7.8 Donation program

leaploot.com may offer the possibility to redeem the Rewards into currency towards a charitable effort of their choice from a list provided by leaploot.com. Through this method, User agrees that if they choose to redeem Rewards for such a donation, that all applicable terms presented on the Website for such donation shall apply in addition to these Terms and Conditions and that User’s Rewards/Balance will be reduced as per the applicable terms of such donation. Each and every donation will be made by leaploot.com, or the indicated associate. These donations will be considered final and cannot be reversed by the User once they have been processed.

leaploot.com reserves, at its sole discretion, the right to modify donation options and processes.

7.9 Roulette Contests

Users, depending on their activities, earn special currency (Spin Credits) which can be used to spin the roulette. When the User spins the roulette, the User may be rewarded with various amounts of COINS from the platform.

leaploot.com reserves the right, at its sole discretion, to modify the conditions and elements regarding Sipin Credits, credit systems, roulette prizes and winning odds.

HELP DESK

leaploot.com offers its Users a Help Desk service provided through the Website. 

From time to time, we may need to deploy or provide patches, updates, additional content or other modifications (each a “Change”) to the Website. We will only do so for important operational reasons, e.g. to adapt the Website to a new technical environment or to an increased number of users, enhance online gameplay, add, update, or remove features, and resolve software bugs.

If there are any material Changes to the Website, they will be notified to the User by the appropriate means, in which due attention will be given to all queries, complaints, and suggestions made in relation to the Services through the Website.

INTELLECTUAL PROPERTY RIGHTS

Based on these Terms and Conditions,leaploot.com grants the User a limited, non-transferable, revocable, non-sublicensable and non-exclusive license to solely access and use the Website on the User's personal hardware device. Any right not expressly granted will be reserved for leaploot.com.

In any case, intellectual and industrial property rights on the services offered and the Website remains property of leaploot.com, associates and partners. 

Moreover, the Services contain copyrighted material, trademarks, and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of the Services are copyrighted as a collective work under copyright laws. leaploot.com owns a copyright in the selection, coordination, arrangement, and enhancement of such content, as well as in the content original to it. Users may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material will be permitted without the express permission of leaploot.com and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made.

REDEMPTION METHODS

Rewards achieved by completing the Objectives found in the Website may be redeemed against gift cards, or other Rewards, prior Mobile Phone verification. Rewards are earned per User and per Mobile Phone number only. If a User changes their Mobile phone number or a User creates and/or uses more than one account they may be blocked/deleted, and any earned Rewards shall be forfeited. 

The User may redeem the Rewards in the appropriate channel of the Website. The User can select amongst the redeemable methods provided by leaploot.com, subject to obtaining a sufficient amount of Rewards prior, unless stocks of the selected redemption method are exhausted. Further, redeemable features may be limited or withheld in cases where the User has not sufficiently interacted with the downloadable apps or advertisements on the Website, and/or if the User’s activity in the leaploot.com’s catalog of apps is unusually low. The User shall not be entitled to be granted a particular method for redemption of the Rewards.

For certain Redemptions, the User may be required to specify some of their details in connection with the payment of the Redemptions (e-mail address and username for his/her online account, if necessary).

Upon request of redemption of Rewards, the petition will usually be processed immediately after the receipt of the request from the User through the Website, provided that the User has used the Website according to the Terms and Conditions. Extraordinary circumstances may cause the transfer to take longer than the stipulated period. leaploot.com fully reserves the right to modify the aforementioned term in accordance with section 2 of these Terms and Conditions.

leaploot.com may also require further information from the Users to ensure that they are not fraudulently earning or redeeming Rewards. To this end, leaploot.com reserves the right to place any redemption of Rewards on hold, for whatever reason, until the requested information has been made available by the User. A sufficient time is given to the User to provide the required information. If the User does not submit the required information, their account may be blocked until all requested information has been submitted. If any fraud or other breach of the Terms and Conditions is detected, leaploot.com shall terminate the account, as well as take the appropriate legal action against this person if deemed necessary.

The applicable rate of conversion for the Rewards will be the one that appears in the Website. These may be modified at any time by leaploot.com in accordance with section 2. On the other hand, promotions and other agreements will be individually or collectively applied, so that publishing any special circumstances shall not be mandatory or be offered to every User.

In case of conversion of the Rewards into gift cards representing an official currency for the desired redeemable method, the redeemable currency of the Rewards marketed in the Website shall be indicated next to the description of the redemption of each one of them, in any case, it shall prioritize the official currency in the User’s country or residence.

To this end, the User will have to give their permission so that leaploot.com may know their location and offer the appropriate redemption methods. In any case, the User will have to select a redemption method from those offered in the Website. Once the Redemption has been granted, the Rewards shall be subtracted accordingly, and the User will not be able to redeem the used Rewards.

RIGHT OF WITHDRAWAL, LEGAL GUARANTEE OF CONFORMITY, FUNCTIONALITY, COMPATIBILITY, AND INTEROPERABILITY

In accordance with the applicable law, Users are informed that they do not have the right to withdraw unless it is otherwise stated in these Terms and Conditions. However, the User shall have the right to unsubscribe at any time in accordance with the procedure described in these Terms and Conditions.

The User is informed that the Website has a legal guarantee. This guarantee will be defined in the Special Conditions of each territory.

The Website has the functionalities described throughout the Terms and Conditions, which will be supplemented by the information about the Website and the Services provided from time to time to the User and the Special Conditions. 

Likewise, the Website is compatible with mobile devices running the latest Android/iOS version and with the latest versions of the most common web-browsers Google Chrome, Apple Safari and Mozilla Firefox running on Windows/MacOS operating systems. leaploot.com will not guarantee the Website will operate adequately in other devices/browsers rather than the ones indicated. The Website may be updated from time to time to adapt to the state of the art, improve its operation or correct errors, among other reasons. 

ELECTRONIC CONTRACTING

The acceptance of these Terms and Conditions by the User shall be equivalent to a contract being celebrated by electronic means, which will produce all the effects foreseen by the appropriate legal system, when the consent and the other requirements necessary for their validity have been met.

In any case, leaploot.com shall log and maintain the User’s electronic acceptance of these Terms and Conditions and such record shall be admissible as evidence in the event of a dispute between the parties.

For these purposes, the User understands and agrees that leaploot.com may monitor all the phases of the Services and, where applicable, the Redemption of the corresponding Rewards to redemption methods.

Similarly, the information regarding the Services and redemption conditions are made available to Users, prior to the start of the contracting procedure, which will only apply if the User decides to proceed with the contracting through the Website.

CONFIDENTIALITY AND DATA PROTECTION

All personal data provided during the use of the Website will be processed in accordance with the provisions of the Privacy Policy that you must read and, where appropriate, accept.

TERM AND MODIFICATIONS

leaploot.com may terminate the User’s account when it detects an unauthorized use or activity of the offered Service, either by breaching substantially these Terms and Conditions or for any other objective reason. If leaploot.com exercises this right, it will not take on any obligation or responsibility, nor will it return to the User the amounts previously earned through Rewards, and the User shall forfeit any Rewards earned and not redeemed. leaploot.com will carry out a review procedure in accordance with its policies of good use of the Website in which it checks if the User has carried out actions contrary to such policies or these Terms and Conditions and/or has obtained Rewards inappropriately. The User may challenge this decision, with leaploot.com taking this matter fully into consideration.

Additionally, Account will automatically deactivate when inactive (no successful signs in) for 1 year. Deactivated accounts will lose any pending balance (not exchanged) that User may have in their accounts. Deactivated accounts may or not be restored, this will be a leaploot.com decision. In any case if leaploot.com accepts to reactivate the account, not all information will be restored. This will include, balance, phone number, ToS/PP acceptance and mail validation statuses and others.

The User may terminate these Terms and Conditions at any time by canceling the Website. However, the obligations that may remain in force after the time of resolution will continue to bind both parties as set forth.

leaploot.com reserves the right, without limitation, to change, modify, delete, add or make any adjustments to the elements, functionalities, Services, features, conditions or any analogues thereof at any time in its sole and exclusive discretion.

However, leaploot.com suggests periodical checking of these Terms and Conditions, as they may be subject to change. If such modifications are substantially made, previous notice will be given for acceptance or rejection. The publication of such modifications in these Website Terms and Conditions shall be deemed a valid and effective communication to Users . If accepted, the modification and entry into force of the new contract will fully replace the conditions in force between the parties to take effect on new purchases or reservations made from the date of acceptance of the new conditions, up to the extent applicable by law. Users' continued use of the Services following the posting of changes and/or modifications shall constitute their acceptance of the revised Terms and Conditions.

The User also acknowledges that acceptance of these Terms and Conditions implies acceptance of any future modifications that leaploot.com may make to these Terms and Conditions at its sole discretion, although it is possible that Users may be invited to accept them again in order to continue using the Services.

TERMINATION

In the event of suspected improper use of the Services or substantial breach of the Terms and Conditions, leaploot.com reserves the right to take appropriate precautions, such as a temporary block of the account, and to terminate the User’s account at a reasonable suspicion. If these suspicions are deemed solved, the blocking will be cleared. Otherwise, leaploot.com has the right to terminate the account. Any breach of the Terms may also result in the User forfeiting all earned Rewards, as well as all other applicable legal claims.

The User acknowledges and agrees that any or all Services of leaploot.com may be terminated in whole or in part at leaploot.com’s sole discretion, without prior notice to the User. leaploot.com does not undertake any risks of loss associated with the termination of the Service.

SAFEGUARD CLAUSE

All the clauses or extremes of the present Terms and Conditions must be independently and autonomously interpreted, and the rest of the stipulations will not be affected in the event that one of them has been declared null and void by means of a judicial decision or a final arbitration resolution. The clause or clauses affected will be replaced by another one or others that preserve the effects pursued by the Terms and Conditions of the Website.

In no event shall leaploot.com, or its respective associates or partners be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or Rewards, or any damages or loss arising from the services provided by third party providers, whether in an action of contract, negligence or other civil liability action, arising out of or in connection with the use of any software, program or platform provided as part of the Service, except in the case of intentional or gross fault.

APPLICABLE LAW AND COMPETENT JURISDICTION

The regulations in force will determine the laws that should govern and the jurisdiction that should know the relationship between leaploot.com and the Users. The Special Conditions for each territory may determine the applicable law and jurisdiction governing the relationship between the parties.

These provisions are without prejudice to the User's right to introduce any action before the competent courts, in accordance with the terms defined in the Special Conditions for each territory. 

In order to file complaints regarding the Services provided by leaploot.com, you may send them via email to [email protected] or to the Registered Office address which can be found in the Identification section at the beginning of this document, and leaploot.comundertakes to seek an amicable solution to the conflict. 

Likewise, if the User is based on a Member State of the European Union, in accordance with the provisions of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013, relating to the resolution of online disputes in the field of consumer affairs, in the event of a dispute, if the User so wishes, he may resort to the "Commission's Dispute Resolution App" to try to resolve out of court any dispute arising from the provision of the Services by leaploot.com. APPLICABLE TAXES

Users agree thatleaploot.comcannot determine in any instance if Rewards or any kind of withdrawal that Users receive are to be reported as taxable income in any of the jurisdictions where leaploot.comoperates and therefore Users are responsible for any taxable liability associated with the use of the Website and any Rewards related with it. 

leaploot.com reserves any right to provide any tax report reports on User's redeemed  Rewards to any tax authority that properly requests it. leaploot.comstrongly recommends that Users seek the advice of an independent tax expert that determines where any User is liable for any tax requirements in their respective jurisdictions for using the service or any Reward earned.

   1. REWARDS

   leaploot.com offers Rewards (the “Rewards”), used as virtual redemption credit in the leaploot.com App, and referred to as “COINS” inside the Website, to Users in exchange for completing Objectives involving playing the downloadable apps found in the Website and from the visualization of Ads. 

   Users can redeem Rewards through different methods, to exchange said Rewards for the currencies offered by leaploot.com, such as gift cards, amongst others (the “Redemption” or the “Redemptions”). 

   All rewards will be exchanged in USD (United States Dollars) at a rate of 1000 coins = 1.00 USD. leaploot.commay in any case adjust (increase or decrease) the amount required to redeem gift cards in other currencies rather than USD depending on the rate of exchange of those currencies against USD..

   Minimum amount for reward to be redeemed will be 5000 coins (equivalent to $5.00). Redemption methods (gift cards, or other) may in any case require a different (higher) minimum to be redeemed, in any case this value will be clearly displayed during the redeem method].

   In addition to the minimum amount, any Redemption method may have a fee that will be deducted from the final amount of the Redemption or added on top of the gift card amount to be redeemed.

   Users will be notified via mail with the link to voucher code or the requirements to obtain the Redemption after the process has been completed and validated.

   The Rewards cannot be redeemed for cash or in any way resold, exchanged, or returned for a cash refund, unless required by law. Rewards may be redeemed in countries where applicable merchants and services are available. Eligible countries to redeem rewards list will be available at the website, the eligible country may vary at leaploot.com’s sole discretion at any time.  leaploot.com is not responsible for any valid Redemptions which the User is unable to redeem due to their age, situation, or country of residence. leaploot.comis not responsible for any lost, stolen, or malfunctioning Redemptions except when caused by gross negligence or wilful misconduct of leaploot.com. 

   2. REDEMPTION METHODS

   Rewards achieved by completing the Challenges found in the Website may be redeemed against gift cards, or other Rewards. Rewards are earned per User and per Mobile Phone Number only. If a User changes their Mobile Phone Number or a User creates and/or uses more than one account they may be blocked/deleted, and any earned Rewards shall be forfeited. 

   The User may redeem the Rewards in the appropriate channel of the Website. The User can select amongst the redeemable methods provided by leaploot.com, subject to obtaining a sufficient amount of Rewards prior, unless stocks of the selected redemption method are exhausted. Further, redeemable features may be limited or withheld in cases where the User has not sufficiently interacted with the downloadable apps or advertisements in the Website, and/or if the User’s activity in the leaploot.com’s catalog of apps is unusually low. The User shall not be entitled to be granted a particular method for redemption of the Rewards. 

   For certain Redemptions, the User may be required to specify some additional personal information in connection with the payment of the Redemptions (bank details, e-mail address and user name for his/her online account, if necessary).

   Upon request of redemption of Rewards, the petition will usually be processed immediately after the receipt of the request from the User through the Website, provided that the User has used the Website according to the Terms and Conditions. Extraordinary circumstances may cause the transfer to take longer than the stipulated period. leaploot.comfully reserves the right to modify the aforementioned term.

   after the receipt may also require further information from the Users to ensure that they are not fraudulently earning or redeeming Rewards. To this end, leaploot.comreserves the right to place any redemption of Rewards on hold, for whatever reason, until the requested information has been made available by the User. A sufficient time is given to the User to provide the required information. If the User does not submit the required information, their account may be blocked until all requested information has been submitted. If any fraud or other breach of the Terms and Conditions is detected, leaploot.comshall terminate the account, as well as take the appropriate legal action against this person if deemed necessary.

   The applicable rate of conversion for the Rewards will be the one that appears in the Website. These may be modified at any time by leaploot.com. On the other hand, promotions and other agreements will be individually or collectively applied, so that publishing any special circumstances shall not be mandatory or be offered to every User.

   In case of conversion of the Rewards into gift cards representing an official currency for the desired redeemable method, the redeemable currency of the Rewards marketed in the Website shall be indicated next to the description of the redemption of each one of them, in any case, it shall prioritize the official currency in the User’s country.

   To this end, the User will have to give their permission so that leaploot.com may know their location and offer the appropriate redemption methods. In any case, the User will have to select a redemption method from those offered in the Website. Once the Redemption has been granted, the Rewards shall be subtracted accordingly, and the User will not be able to redeem the used Rewards.

   3. US COPYRIGHT COMPLAINTS

   We respect the intellectual property rights of others. If you believe that your material has been copied in a way that constitutes copyright infringement, please provide our copyright agent the following written information:

   1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
   2. a description of the copyrighted work that you claim has been infringed upon;
   3. a description of where the material that you claim is infringing is located on the Site;
   4. your address, telephone number, and e-mail address;
   5. a statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
   6. a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner of authorized to act on the copyright owner’s behalf.    It is often difficult to determine if your intellectual property rights have been violated or if the Digital Millennium Copyright Act (DMCA) requirements have been met. We may request additional information before we remove any infringing material. If a dispute develops as to the correct owner of the rights in question, we reserve the right to remove or disable access to the allegedly infringing material pending resolution of the matter. We will terminate the accounts of users that we determine are repeat infringers. 

   Please note that under Section 512(f) of the Copyright Act any person who makes false claims that material or an activity is infringing may be subject to liability for damages.

   4. APPLICABLE LAW FOR US

   Provided that the current regulations foresee the possibility for the parties to submit to a specific jurisdiction, for any litigious matter arising from or related to this Website, the Spanish legislation in force at the time of the dispute shall apply, and the User and the Holder shall submit to the Courts and Tribunals of the City of Madrid.
